These Terms and Conditions govern your use of the website www.laurenlepley.com and any services provided by Elvara Ltd (trading as Ellvara). By using this website or engaging our services, you agree to be bound by these terms.

1. Services

Ellvara provides coaching, consulting, mentoring, and somatic support services. The specific nature of the services, programme structure, duration, and investment will be set out in a separate Client Agreement signed by both parties before work begins.

The services provided do not constitute therapy, medical advice, legal advice, or financial advice. Clients are responsible for their own decisions and actions.

2. Website use

This website is provided for general information purposes. While we take reasonable care to ensure the content is accurate and up to date, we do not guarantee that the information on the website is complete, accurate, or current.

You may not use this website in any way that is unlawful, harmful, or fraudulent, or in connection with any unlawful, harmful, or fraudulent purpose or activity.

We reserve the right to update, change, or remove content from the website at any time without notice.

3. Bookings and client agreements

All coaching, consulting, and programme services are subject to a signed Client Agreement. The Client Agreement sets out the specific terms of the engagement, including the programme description, investment, payment terms, cancellation policy, and scheduling arrangements.

In the event of any conflict between these Terms and Conditions and a signed Client Agreement, the terms of the signed Client Agreement shall take precedence.

4. Payment

Payment terms are set out in the relevant Client Agreement. Where payment is made via Stripe, processing is handled securely by Stripe in accordance with their own terms of service and privacy policy. Where payment is made by bank transfer, details will be provided on the relevant invoice.

All fees are quoted in GBP unless otherwise stated.

5. Cancellation and refunds

Our cancellation and refund policy is set out in the Client Agreement. In summary:

Where a Client Agreement is entered into at a distance (online or by email), the Client has a statutory right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If services have not yet commenced, a full refund will be provided. Once services have commenced with the Client's express consent, this right is lost.

Subject to the above, all payments are non-refundable once the programme has started. Full details are set out in the Client Agreement.

6. Scheduling and attendance

Session scheduling, rescheduling, cancellation notice periods, and the forfeiture of missed sessions are governed by the Client Agreement. In summary, clients are required to provide a minimum of 48 hours' notice to reschedule a session. Sessions cancelled with fewer than 48 hours' notice or missed without notice are forfeited and will not be refunded, rescheduled, or credited.

7. Intellectual property

All content on this website, including text, images, graphics, logos, and downloadable materials, is the property of Elvara Ltd unless otherwise stated. You may not reproduce, distribute, or use any content from this website without prior written consent.

All frameworks, tools, resources, and materials provided during a programme remain the exclusive property of Elvara Ltd. Clients are granted a personal, non-exclusive, non-transferable licence for their own use only, as set out in the Client Agreement.

8. Limitation of liability

To the fullest extent permitted by law, Elvara Ltd shall not be liable for any indirect, incidental, or consequential loss or damage arising from the use of this website or from any services provided.

Our total liability in connection with any services provided shall not exceed the total fees paid by the Client under the relevant Client Agreement.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

9. Third-party links

This website may contain links to third-party websites. These links are provided for convenience only. We have no control over the content or availability of those websites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

10. Confidentiality

Any information shared with us in the course of a client engagement will be treated as confidential, as set out in the Client Agreement.

We will not use a client's name, likeness, or details in marketing, testimonials, or promotional materials without prior written consent.

We reserve the right to disclose information where necessary for the physical or mental welfare of the client or any third party, or as required by law.

11. Data protection

We take your privacy seriously. Personal data is processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Full details of how we collect, use, and store your data are set out in our Privacy Policy at www.laurenlepley.com/privacy-policy.

12. Dispute resolution

In the event of any dispute, both parties agree to attempt to resolve the matter informally in the first instance. If the dispute cannot be resolved informally within 14 days, the parties agree to consider mediation before commencing any legal proceedings.

13. Governing law

These Terms and Conditions are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction in relation to any disputes arising from these terms.

14. Changes to these terms

We may update these Terms and Conditions from time to time. Any changes will be posted on this page with an updated revision date. Continued use of the website or services after any changes constitutes acceptance of the revised terms.
